Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy explains how Condition Beauty, LLC ("Condition Beauty," "we," "our," or "us") collects, uses, and shares consumer health data, and the rights you have regarding that data.
This policy applies to residents of Washington State under the My Health My Data Act, and to residents of Nevada under Nevada Senate Bill 370. It supplements our general Privacy Policy and our Terms of Service.
You must be 18 or older to use our Services.
What we mean by consumer health data
Washington and Nevada law define "consumer health data" broadly. It includes information that identifies your past, present, or future physical or mental health status, including symptoms, bodily functions, and conditions.
Condition provides a hairstyle try-on and planning tool. Some of the information you give us about your hair may fall within these definitions.
What we collect
We collect the following information that may be consumer health data:
Hair and scalp information you provide
Hair texture, curl pattern, porosity, and density
Chemical and structural history, including whether your hair is natural, transitioning, relaxed, texlaxed, loc'd, color-treated, or bleached
Goals and priorities you select, which may include scalp comfort (such as itching or flaking) and edge or hairline recovery
Lifestyle factors such as sweating, chlorine exposure, humidity, and headwear
How you describe your current relationship with your hair
Journal entries and notes you write, including how a style felt and the condition of your edges
Check-ins recording how you feel about your hair
Images
Photographs you upload showing your hair and scalp
Try-on images generated from those photographs
Observations we generate
Summarized conclusions our AI draws about your hair from your activity in the app. These are generated by our system, not statements you made.
We do not collect biometric data. Our try-on technology generates a new image from the images you provide. It does not create a faceprint, facial template, or scan of facial geometry, and it does not use facial characteristics to identify you.
How we collect it
We collect this information directly from you — through onboarding questions, notes and check-ins you write, settings you choose, and images you upload.
We do not purchase consumer health data, and we do not collect it from data brokers, public records, or other outside sources.
Why we collect it
We use consumer health data only to:
generate hairstyle try-on images for you
suggest hairstyles and products that may suit your hair
maintain your hair journal, plans, and calendar
personalize your experience within the app
respond to your support requests
keep the Services secure and functioning
We do not use consumer health data for advertising. We do not build advertising profiles, we do not use tracking pixels or advertising SDKs, and we do not participate in cross-context behavioral advertising.
We do not use consumer health data to train AI models.
Who receives it
We share consumer health data only with service providers who need it to operate the Services, under written contracts that limit their use of it to the purposes we specify and prohibit them from using it for their own purposes.

Purpose: Text generation and search
Google does not use the images or text we send to train or improve its products, and processes them as our data processor. Google retains request logs for a limited period for abuse detection and legal compliance, up to a maximum of 55 days under its published policy.
Images you upload from your camera roll are reviewed by Condition Beauty staff before they are accepted into the app.
Generated try-on images may be shown to other users if the "share my photos with condition" setting in your account is on. You can turn it off at any time in Settings.
We may also disclose consumer health data where required by law — for example, in response to a warrant, subpoena, or court order — or where necessary to protect the rights, property, or safety of Condition Beauty, our users, or the public.
We do not sell consumer health data
We do not sell consumer health data, and we have not sold it. Washington law requires separate, specific written authorization before any sale. We do not seek that authorization because we do not sell this data. If that ever changes, we will obtain valid authorization first.
How long we keep it
We retain consumer health data for as long as your account is active, so that your hair profile, journal, and plans remain available to you.
When you request deletion, we delete it as described below.
Your rights
If you are a Washington or Nevada resident, you have the right to:
Know whether we collect, share, or sell your consumer health data, and who receives it
Access the consumer health data we hold about you, including a list of who has received it
Withdraw consent to our collection and sharing of your consumer health data
Delete your consumer health data
How to exercise these rights
Email contact@conditionbeauty.com with the subject line "Consumer Health Data Request." Tell us which right you want to exercise and the email address associated with your account.
We will respond within 45 days. If we need more time, we will tell you why and may extend by an additional 45 days.
You may designate an authorized agent to make a request on your behalf. We may ask you to verify your identity, or to confirm that the agent is authorized.
What deletion means
When you request deletion, we delete your consumer health data from our active systems and notify our service providers to delete it from theirs. We confirm when the deletion is complete. We may retain information where required by law, or where necessary to resolve disputes or maintain security.
If we deny your request
If we deny your request, we will tell you why, and you may appeal by replying to our response. We will respond to an appeal within 45 days. If we deny the appeal, we will tell you how to contact the Washington Attorney General.

Washington residents may file a complaint with the Washington State Attorney General:

Changes to this policy
We may update this policy from time to time. We will update the "Last Updated" date above. If we make material changes to how we handle consumer health data, we will notify you through the app, by email, or both, and where required we will obtain your consent before the changes take effect.
