Terms of Service

Last Updated: July 31, 2026

At Condition Beauty, LLC ("Condition Beauty," "we," "our," or "us"), your privacy is important to us. The nature of our Services requires trust, especially when you share photos of yourself. Thank you for trusting us.

This Privacy Policy explains what information we collect, how and why it is used, how artificial intelligence ("AI") technologies process the photos you upload, what choices you have, and your rights regarding your data.

This Policy applies to all websites, mobile applications, and other services provided by Condition Beauty that link to it (collectively, the "Services").

Condition provides a virtual hairstyle try-on and planning tool. You upload a photo of yourself and a hairstyle inspiration image, and our Services generate a new image showing that hairstyle on your photo. You can also save styles, keep notes, and plan hairstyles around upcoming events.

You must be 18 or older to use the Services.

By using the Services, you agree to the practices described in this Policy. If you do not agree to this Policy or our Terms of Service, please do not use the Services.

Capitalized terms not defined here have the meanings given in our Terms of Service.

1. Information We Collect

In summary: We collect what you give us when you set up your account and use the app — your name, your email, photos of yourself, hairstyle inspiration images, and information about your hair. We also collect basic technical information about your device.

Information you provide directly

Account information

  • First name

  • Email address associated with your Apple ID

  • Phone number, if you provide one

Images

  • Photos of yourself that you upload for hairstyle try-on

  • Hairstyle inspiration images you upload or select

  • Generated try-on images produced by the Services

Information about your hair. During setup and as you use the app, we collect information you provide about your hair, which may include:

  • Texture, curl pattern, porosity, and density

  • Chemical and structural history, such as whether your hair is natural, transitioning, relaxed, texlaxed, loc'd, color-treated, or bleached

  • Lifestyle factors such as sweating, chlorine exposure, humidity, and headwear

  • Your styling goals and priorities, which may include scalp comfort (such as itching or flaking) and edge or hairline recovery

  • How you describe your current relationship with your hair

  • Notes and journal entries you write, including how a style felt, products you used, and photos you attach

  • Check-ins recording how you feel about your hair

Planning information

  • Upcoming events, dates, and hair plans you enter

Inferences we generate. As you use the Services, our AI generates and stores summarized observations about your hair — for example, that a certain style or product seems to work well for you. These are conclusions our system draws, not statements you made. You can request a copy or ask us to delete them.

Information we collect automatically

We collect basic technical information necessary to operate the Services, including device type, operating system, app version, IP address, and access times. Our hosting provider records standard server request logs.

We do not use analytics SDKs, advertising SDKs, or tracking pixels. We do not access your device advertising identifier. We do not build advertising profiles, and we do not participate in cross-context behavioral advertising.

2. Photos You Upload

In summary: Your photos are sent to Google to generate try-on images. Google does not train on them. Staff review images you upload. By default, generated images showing your face are shown to other users — you can turn this off in Settings. We do not create a faceprint or collect biometric information.

What happens to your photo

When you request a try-on, your photo and your inspiration image are sent to Google's Gemini API, which generates a new image showing the hairstyle on you. The generated image is returned to the app and stored in your account.

What we do not do

We do not:

  • create, derive, or store a faceprint, facial template, facial embedding, or scan of face geometry;

  • measure or record the distinctive structure of your face;

  • use any facial characteristic to identify you, verify your identity, or distinguish you from any other individual;

  • collect "biometric identifiers" or "biometric information" as defined under the Illinois Biometric Information Privacy Act, the Texas Capture or Use of Biometric Identifier Act, the Washington Biometric Privacy Act, or similar laws;

  • use your photos to train, develop, or improve AI models; or

  • sell, lease, trade, or otherwise profit from your photos.

Google's handling of your images

We use Google's Gemini API on a paid plan. Under Google's terms for paid services, Google does not use the images or prompts we send, or the images it generates, to train or improve its products, and processes them as our data processor.

Google retains logs of requests — which include the images sent — for a limited period for abuse detection, safety, and legal compliance purposes. Google's published policy provides for a maximum retention period of 55 days, after which logs are marked for deletion.

Human review

Images you upload from your camera roll are reviewed by Condition Beauty staff before they are accepted into the app. This means a person at Condition Beauty may view images you upload.

Sharing generated images with other users

Please read this section carefully. It is on by default.

Your account includes a setting called "share my photos with condition."This setting is turned on when you create your account.

While it is on, try-on images generated from your photo — photorealistic images showing your face — may be added to our shared inspiration library and shown to other users of the Services as style recommendations and feed content. Other users can see these images. We do not control what other users do with images they see.

You can turn this off at any time, in Settings under "share my photos with condition." When you turn it off:

  • we stop adding new images of you to the shared library, and

  • we remove your images from the shared library going forward.

Images that other users have already seen or saved cannot be recalled.

If you do not want images of your face shown to other users, turn this setting off before you create your first try-on.

3. How We Use Information

We use the information we collect to:

(i) provide and operate the Services, including hairstyle try-on, planning, and notes; (ii) personalize your experience, including suggesting hairstyles based on your own account activity; (iii) communicate with you about your account, updates, or changes to our terms and policies; (iv) respond to your questions and support requests; (v) review uploaded images for compliance with our Terms of Service; (vi) maintain, troubleshoot, and improve the Services using aggregated or de-identified data; (vii) detect and prevent fraud, misuse, and security incidents; and (viii) comply with legal obligations and protect the rights, safety, and property of Condition Beauty, our users, and others.

We do not use your information to train AI models. No model — ours or a third party's — is trained on your photos, your notes, or anything else you provide.

4. When We Disclose Information

In summary: We share information with the service providers who make the app work, and in limited legal circumstances. We do not sell your personal information and we do not share it for advertising.

6. Regional Disclosures

Illinois, Texas, and Washington — biometric laws

We are aware of the Illinois Biometric Information Privacy Act (740 ILCS 14/), the Texas Capture or Use of Biometric Identifier Act (Tex. Bus. & Com. Code § 503.001), and the Washington Biometric Privacy Act (Wash. Rev. Code § 19.375). The Services do not collect, capture, or otherwise obtain biometric identifiers or biometric information. Washington — consumer health data

Some of the information we collect about your hair may qualify as "consumer health data" under the Washington My Health My Data Act. Our Consumer Health Data Privacy Policy describes what we collect, how we use it, who receives it, and how to exercise your rights under that law. Washington residents should read it in addition to this Policy.

We do not sell or share personal information as those terms are defined by the CCPA. We do not use sensitive personal information for purposes that would require us to offer a right to limit its use.

California residents may exercise the rights described in Section 5.

Nevada

Nevada residents may opt out of the sale of personal information to unaffiliated parties. We do not sell personal information as defined in Nevada Revised Statutes Chapter 603A. To submit a request, email us with the subject line "Nevada Do Not Sell Request."

Do Not Track

We do not respond to browser-initiated Do Not Track signals.

Notes, plans, and observations. Retained while your account is active.

Operational logs. Records of AI requests are retained for troubleshooting and security purposes.

Deletion. When you request deletion under Section 5, we delete your information and confirm when the deletion is complete, except where retention is required by law or necessary to resolve disputes or maintain security.
